Medical personnel contribute to the observance of fundamental human rights, enshrined in art. 22 of the Romanian Constitution, the right to life and the right to physical and mental integrity. The exercise of such a profession is carried out by providing medical assistance services, based on ethical and legal norms. The ethical norms establish the specific moral foundation for the exercise of this profession, and to the extent that their violation endangers values protected by national and international legislation, the norms are regulated, acquiring legal validity. The main obligations of the doctor within the doctor-patient legal relationship are the correlative obligations of the patients' rights. One of the most important obligations of the physician is the duty of care – to provide care that is attentive, conscientious and in accordance with the current data of medical science. Everyone has the right to receive the most suitable care and to benefit from therapies whose effectiveness is recognized and guarantee the best health security in terms of diagnosing the disease, establishing the treatment and curing or improving the health of the patient.
