The importance of mediation in cases of international child abduction

Abstract

Worldwide statistics on divorce creates a concern about the emotional stability of the children resulting from these marriages ended in divorce or separation in fact, having parents of different nationalities. Mediation these causes may be the best solution for resolving these problems and achieve the best interests of the child. Thus, in 2008, 706 applications were submitted for the return between Member States. Statistics show that the overall rate of return between Member States was 52% in 2008 and by 39% if the requesting State has been a third country: Statistical analysis of applications submitted in 2008 under the Convention of the Hague of 25 October 1980 on the civil aspects of international child abduction - Part II - regional report, Prel.
